Terms of Service
InfoServe
Media has a responsibility
to protect each client and to provide the best services available.
The following guidelines were designed to ensure these obligations
are met:
Content
All services provided by InfoServe Media may be used for lawful purposes
only. Transmission, storage, or presentation of any information,
data, or material in violation of any United States Federal, State,
or City law is prohibited. This includes, but is not limited to:
copyrighted material, material judged to be threatening or obscene,
material protected by trade secret or other statute, or material that constitutes an invasion
of privacy. The subscriber agrees to indemnify and hold harmless
InfoServe Media from any claims resulting from the use of the service
which results in damages sustained by the subscriber or any other party.
Sites that promote any illegal activity or present
content that may be damaging to InfoServe Media servers or any other
server on the Internet are prohibited. Links to such materials are also prohibited.

InfoServe
Media will be the sole arbiter as to what constitutes a violation of
this provision.
Commercial Advertising - E-mail
Spamming, or the sending
of unsolicited e-mail, from an InfoServe Media server, or using an e-mail
address or domain that is maintained on an InfoServe Media sever as
reference is strictly prohibited.
InfoServe Media will be the sole arbiter as to what constitutes a violation
of this provision.
Intellectual
Property Violations
Engaging in any activity that infringes
or misappropriates the intellectual property rights of others, including
copyrights, trademarks, service marks, trade secrets,
and patents held by individuals, corporations, or other entities is prohibited.
Also prohibited is any activity that violates privacy or publicity
rights of others. InfoServe Media is required by law
to remove or block access to customer content upon receipt of a
proper notice of copyright infringement. It is also InfoServe Media's
policy to terminate the accounts of customers who commit repeat
violations of copyright laws
Misuse
of System Resources
Any attempt to undermine or cause harm
to a server, or customer, of InfoServe Media is strictly prohibited.
This includes, but is not limited to: using programs that consume
excessive CPU time; allowing the use of mail services, mail forwarding
capabilities, or autoresponders other than for the customer's own
account; resale of disk space without an appropriate reseller agreement;
use of servers for backup of files unrelated to the web site of
the account; or resale or remote access to CGI scripts installed
on our servers. Operation of IRC servers or IRC bots on InfoServe Media servers
will result in an immediate suspension of service.
Other
Activities
Engaging in activities, whether lawful or unlawful,
that InfoServe Media determines to be harmful to its subscribers, operations,
reputation, goodwill, or customer relations is prohibited.
Data Integrity
A backup of all Web site, email, and database data is made once daily. Although every conceivable effort is taken to ensure the integrity of the hosted data, InfoServe Media cannot be held
responsible for the loss of data from any Web site, email, or database. All clients are reminded to maintain a current copy of their
Web site, emails, and databases on their local systems.
Cancellation
Cancellation of Web hosting services can be made at any time by sending a written request here.
No notice is required, and there is no cancellation fee, but
all fees paid for service up to the notice of cancellation
are non-refundable. If cancellation is made within the first 30 days
of service, all hosting fees will be refunded. This does not include
fees for domain registration or fees on additional features such
as additional space or bandwidth. Refunds will not
be issued to any client whose account has been deactivated because of Terms
of Service violation(s).
Suspension
Activity which results in a suspension or deactivation of an account
will result in a forfeiture of fees paid. Complaints made regarding
abuses of an account will be grounds for suspension.
Refusal
of Service
InfoServe Media reserves the right to refuse, cancel, or suspend
service at its sole discretion. All sub-networks, distributive hosting
sites, and dedicated servers of InfoServe Media must adhere to the above
policies. Please send a written notice of violations of the above policies here.
Billing Terms
All invoices posted to your account will be due and payable on receipt. Delinquent accounts will receive automatic e-mail reminders after 30 days non-payment.
Delinquent accounts will be suspended after 60 days non-payment, with service to be reinstated after payment in full is received. Delinquent accounts' settings and data will be permanently deleted from the server(s) after 90 days non-payment.
All charges will be considered valid unless otherwise disputed in writing within 10 days from invoice submittal. After this time, InfoServe Media, LLC will consider your bill to be correct.
If the account becomes delinquent, and it becomes necessary to forward this account to an attorney or collection agency for collection, the Customer agrees to pay any reasonable attorney or collection agency fees, plus all other reasonable costs for collection, including court costs.
Failure
to follow any term or condition will be grounds for immediate account
deactivation.
